By having Kathryn Kittinger photograph your child, using this site or submitting an order to Shoogie Boogies, you indicate your agreement to these Terms & Conditions. 

Child Supervision:  Shoogie Boogies LLC strictly requires that all children photographed must be accompanied by a parent or adult guardian at all times before, during and after a photo shoot.  Kathryn Kittinger and her assistants must concentrate fully on photographing the children and will not be responsible for children’s safety before, during or after any photo shoot.

In situations where parents may not attend the photo shoots, such as in preschools or daycares, the school or group organizing the photo event must accompany the children to their photo sessions.  The school or organization is solely responsible for the children’s safety before, during and after all photo shoots.

48 Hour Cancellation Policy for Photo Shoot:  Please cancel your photo shoot 48 hours or more before your appointment to avoid having $175 charged to your credit card.   While we try to call or email to remind our clients of their appointments, we still plan for the client to keep their appointment time, unless they call to cancel 48hrs or more in advance.

No Cancellation/No Shows - will be charged $175 plus any transit time will be prorated at $175/hour.

Billing for Photo Shoot:  Billing begins at the photo shoot appointment time and includes any preparatory time needed by the photographer to set up the shots or any wait time for the family to prepare for the shots.  Your credit card will be charged the flat sitting fee plus tax, for the first hour or less on location.  Any additional minutes beyond the first hour will be prorated at the hourly rate and rounded to the next highest dollar plus tax.  Please tell the photographer when you are ready to stop photographing. 

Billing for Transit/Waite Time:  Drive time to and from appt. and any wait time will be billed at the prorated hourly fee.  

Parking and Entrance fees:  Some public parks charge entrance or parking fees, and sometimes a metered spot or parking garage is the best or only available parking for a photo shoot.  If this is the case with your photo shoot location, any fees will be added onto your sitting fee and rounded to the next highest dollar.

10 day Viewing & Ordering Policy:   (Visa, MC or Cash Only)  You have 10 days to view, order & pay for photos.   (Exception:  Clients will be informed when photographer is traveling in their city for a limited # of days.)  Photos not ordered by the given deadline are subject to deletion.   Only photos ordered and paid for during the first viewing and ordering appointment will be archived.  Photos not ordered and paid for at that appointment will be deleted.     Shoogie Boogies makes every attempt to safely archive the photos you order for at least one year from your original order date.  However, Shoogie Boogies is not responsible for lost or damaged digital files in our archives.

Return Policy:  If you are not completely satisfied with your photographs when you receive them, please contact SB within 14 days of receipt of shipment.  Shoogie Boogies will be happy to replace your photos with quality photos of the same poses you ordered.

Regarding group class pictures:   Each parent or adult representative is responsible for accurately and legibly completing the customer information sheet at or prior to the photo shoot.  Shoogie Boogies will reference this info sheet, when creating the group class pictures.  If Shoogie Boogies spells a child’s name differently from the info sheet or places the child’s photo in a class picture different from what the parent indicated on the info sheet, Shoogie Boogies will replace the picture with a corrected picture.

Sales Taxes:  Shoogie Boogies charges sales taxes, in accordance with the state in which the photographs were taken.  Some states require a tax on the delivery charge.  You are responsible for paying applicable sales taxes.  Any questions regarding sales taxes should be directed to SB.

Payment Options:   We accept Visa, MasterCard, Discover, Check Card or Cash.  Sorry, no checks.

Copyright and Trademark Information:  It is illegal to download, print or reproduce photographs taken by Kathryn Kittinger.  Kathryn Kittinger owns the copyrights of the photographs on this site and the copyrights to all photos she takes for you.  All her images, in print and electronic form, are copyrighted and may not be reproduced, distributed, modified, retransmitted, published, printed or publicly displayed without the written consent of Kathryn Kittinger.  In the event that you reproduce, publicly display, modify, transmit, distribute publish, print or otherwise exploit the photographs, or any portion thereof, in any manner not authorized by Kathryn Kittinger, or if you otherwise infringe any intellectual property rights relating to the photography, products, or this web site, you agree to indemnify and hold Shoogie Boogies LLC, its subsidiaries, affiliates, licensees and representatives harmless against any losses, expenses, costs, or damages, including reasonable attorney’s fees, incurred by them as a result of unauthorized use of the photography or products and/or your breach of the terms of this agreement.

In addition to the photographs, all screens appearing on this site, text elements and site design are the sole property of Shoogie Boogies and are copyrighted by Shoogie Boogies, with the exception of any Microsoft clip art. 

The name, “Shoogie Boogies™”, is trademarked and is the exclusive copyrighted property of Kathryn Kittinger.   Shoogie Boogies™ may not be reproduced, distributed, modified, retransmitted, published, printed or publicly displayed without the written consent of Kathryn Kittinger.

Order Acceptance Policy:  Kathryn Kittinger only photographs children in the most innocent and positive light.  She reserves the right to decline any photo opportunity for any reason.

Bounced Checks:  If Shoogie Boogies does decide to accept a check and the check bounces, Shoogie Boogies will charge the customer a minimum $30.00 bounce fee and hold the order until total payment and penalty is rendered.

Lost/Damaged Digital Photos:  Shoogie Boogies makes every attempt to safely archive the photos you order for at least one year from your original order date.  However, Shoogie Boogies is not responsible for lost or damaged digital files in our archives.

Shoogie Boogies makes every attempt to protect the digital photos taken at your photo shoot.  In the rare event that a photo you order is accidentally deleted from our database before we can process your order, we will refund you your money for that photo or replace it with another photo of your choice.

 Miscellaneous:  Shoogie Boogies reserves the right to make changes to this site and to these Terms & Conditions at any time.  Any modifications will become effective when they are first posted to this site.
